Pass in Hand Terms of Service
Effective date: October 26, 2026
Operator: FlowPass LLC, a Massachusetts limited liability company ("FlowPass", "we", "us")
Contact: [email protected]
These terms govern your use of Pass in Hand: Wallet Loyalty (the "App") as a Shopify merchant ("you"). By installing or using the App, you agree to them. If you use the App for a company, you confirm you can bind that company to these terms. Your use of Shopify itself is governed by Shopify's terms.
1. What the App does
The App lets you run a loyalty program for your Shopify store. Your customers get a loyalty card in Apple Wallet or Google Wallet. With the App you can:
- award points on paid orders and take them back on refunds
- let customers redeem points for single-use discount codes online, or at Shopify POS on paid plans
- show a store credit balance instead of points
- send short push messages to card holders
On your behalf, the App emails customers who have an email address a welcome message with a link to their card, and a message when they move up a tier (see the Privacy Policy). The App does not send text messages (SMS) to your customers.
2. Plans and billing
| Plan | Price | Pass limit | Shopify POS tile |
|---|---|---|---|
| Free | $0 | 100 passes | Not included |
| Starter | $19 per month | 1,000 passes | Included |
| Growth | $49 per month | 5,000 passes | Included |
| Pro | $99 per month | 20,000 passes | Included |
- Passes. Each customer counts as one pass per store, however many wallets or devices they add the card to.
- Free plan and trials. There is no free trial. The Free plan is free for as long as you use it.
- Billing. Paid plans are billed monthly through Shopify's billing system, in USD unless Shopify shows otherwise, and appear on your Shopify invoice. Taxes may apply. Shopify's own billing terms also apply.
- Cancellation and refunds. You can cancel any time by downgrading to Free or uninstalling the App. Cancellation takes effect at the end of your current billing period. We don't refund partial months, except where the law or Shopify's policies require it.
- Upgrades. You can upgrade at any time on the Billing & Plans page. Shopify handles any proration.
- Downgrades. You can downgrade only if your current number of passes fits within the lower plan's limit. If it doesn't, the App explains why and blocks the downgrade.
- Pass limit. When you reach your plan's limit, existing cards keep working and updating, but new cards can't be issued until you upgrade.
- Price changes. We will give you at least 30 days' notice of any price change. Price changes take effect at your next billing period after the notice period.
3. Your responsibilities
You agree to:
- run your loyalty program, including its rules, rewards, point values and expiry, and honor rewards as you describe them to customers
- give your customers any notices about the program and obtain any consents that the law requires, including a privacy notice that covers loyalty data, the customer emails and any program terms
- send push messages only about your program and your store, and only lawful content. Don't use them for spam or for third-party advertising.
- not use the App for unlawful, deceptive or harmful purposes, and not try to break, overload, reverse engineer or get around its limits or security
- keep your Shopify account and staff access secure
Points and rewards are your promotional program. They have no cash value from FlowPass, and FlowPass is not responsible for the value you assign to them.
4. Customer data
- You control your customers' personal data. We process it on your behalf to provide the App, as described in our Privacy Policy.
- We do not sell it, and we use it only to provide and support the App.
- When Shopify sends us a data request or deletion request, we handle it as the Privacy Policy describes.
5. Third-party services
The App depends on Shopify, Apple Wallet, Google Wallet, our hosting provider (Render), our authentication provider (Supabase), Apple Push Notification service, and our email (Mailtrap) and monitoring (Apitally, Sentry) providers. We don't control them. Their availability, rules and changes, such as wallet card approval, publishing status or API changes, can affect the App. Your use of those services is governed by their own terms.
6. Intellectual property
We own the App and its software and branding. While you use the App, we grant you a limited, non-exclusive, non-transferable right to use it for your store. You keep ownership of your content: logos, images, program text and messages. You give us permission to use it to provide the App, for example to put your logo on your cards and in customer emails.
7. Availability and changes
We work to keep the App available and accurate, but we don't guarantee it will be uninterrupted or error-free. We may change or discontinue features. If a change materially reduces the features of your paid plan, we will give you at least 30 days' notice.
8. Disclaimers
To the extent the law allows, the App is provided "as is" and "as available", without warranties of any kind, express or implied. That includes merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the extent the law allows:
- FlowPass is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.
- Our total liability for all claims relating to the App is limited to the fees you paid us for the App in the 12 months before the claim.
10. Indemnity
You will defend and indemnify FlowPass against third-party claims arising from your loyalty program, your content or messages, or your breach of these terms or of the law.
11. Ending your use
You can stop using the App at any time by uninstalling it from your Shopify admin. Uninstalling cancels your Shopify app subscription. We may suspend or end your access if you materially breach these terms, or if we must do so by law or under Shopify's requirements. After you uninstall, we delete your store's data, including your loyalty members in the FlowPass backend, as described in the Privacy Policy. Cards already in customers' wallets stop updating.
12. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in Suffolk County, Massachusetts, unless the law where you are located requires otherwise.
13. Changes to these terms
We may update these terms. We will post the new version here with a new effective date. If a change is material, we will notify you in the App or by email. Continuing to use the App after a change takes effect means you accept the change.
